
Unregistered Rights United KingdomUnregistered rights exist automatically as soon as the design is produced. However the protection is only against copying and unregistered rights are not a monopoly right. However unregistered design rights can be of use in the development of an article particularly if it is the intention to seek registered design rights within 12 months from when the design was produced. If there is an intention to protect an article by United Kingdom Registered Design Rights there is a need to be aware that disclosure can invalidate the entitlement to seek protection in some foreign jurisdictions. It should be appreciated that as an independent right an unregistered design only lasts for a period of three years from when the design was first made available.
